Biancalani Prevails in Chinese Patent Infringement Litigation
Biancalani is pleased to announce that it has obtained a favorable first-instance judgment in its patent infringement case against the Chinese textile machinery manufacturer Jiangyin Yuefa Printing and Dyeing Machinery Co., Ltd. (Refatech).
Applying the Patent Law of the People’s Republic of China, the Wuxi Intermediate People’s Court upheld Biancalani’s claims and determined that Refatech infringed two Chinese patents covering Biancalani Textile Machinery’s proprietary AQUARIA® technology.
The judgment confirms infringement of both:
- the patented continuous open-width fabric washing method; and
- the patented machine and method for continuous open-width fabric washing.
Court Orders Immediate Injunction and Compensation
As part of the first-instance ruling, the Court ordered Refatech to:
- Immediately cease the manufacture, sale, and offering for sale of the infringing textile machinery;
- Pay RMB 2,000,000 in compensation to Biancalani; and
- Reimburse Biancalani’s litigation costs.
